Terms and Conditions for Clinical Readiness Session

1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the Clinical Readiness Session service ("Service" or "Interview Service") provided by ADHD Tester ("we," "us," "our," or "Company"). The Service includes, but is not limited to, AI-powered clinical interview simulator sessions, cognitive assessments, screening questionnaires, PDF report generation, and related features.

BY CLICKING "I AGREE," MAKING A PAYMENT, OR ACCESSING OR USING THE SERVICE IN ANY MANNER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THESE TERMS AND CONDITIONS.If you do not agree to these Terms, you must not access or use the Service, and you must not proceed with payment.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ADHD Tester. If you are accessing or using the Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.

THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADHD TESTER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Any warranties of merchantability, fitness for a particular purpose, or non-infringement
• Any warranties regarding the accuracy, reliability, completeness, or usefulness of the Service or its outputs
• Any warranties that the Service will be uninterrupted, error-free, secure, or free from viruses or harmful components
• Any warranties regarding the compatibility of the Service with your device, browser, or software
• Any warranties that the Service will meet your requirements or expectations
• Any warranties regarding the quality, accuracy, or reliability of AI-generated content, reports, or recommendations
• Any warranties that the Service will help you obtain a diagnosis, treatment, or positive outcome
• Any warranties regarding data security, privacy, or confidentiality

You acknowledge that the Service may contain bugs, errors, defects, or other limitations, and that the Company does not warrant that any such issues will be corrected. The Company may modify, suspend, or discontinue the Service at any time without notice or liability.

4. Limitation of Liability - Maximum Protection

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADHD TESTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, use, goodwill, or other intangible losses
• Medical expenses, treatment costs, or healthcare-related expenses
• Losses resulting from medical decisions made based on the Service or its outputs
• Losses resulting from misdiagnosis, delayed diagnosis, or failure to seek appropriate medical care
• Emotional distress, mental anguish, or psychological harm
• Losses resulting from data breaches, unauthorized access, or privacy violations
• Losses resulting from service interruptions, errors, bugs, or technical failures
• Losses resulting from AI errors, inaccuracies, or inappropriate content
• Losses resulting from reliance on reports, recommendations, or outputs from the Service
• Losses resulting from changes to or discontinuation of the Service
• Any other damages arising from your use or inability to use the Service

OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS, THE SERVICE, OR YOUR USE THEREOF, REGARDLESS OF THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. However, to the maximum extent permitted by law, the limitations and exclusions set forth above shall apply.

5. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.You understand and accept that:

• The Service may not work as intended, may contain errors, or may produce inaccurate or inappropriate results
• AI-generated content may be incorrect, incomplete, misleading, or harmful
• The Service may not help you prepare for your actual clinical assessment or achieve any desired outcome
• Technical failures, bugs, or service interruptions may occur at any time
• Data loss, corruption, or unauthorized access may occur despite security measures
• The Service may be modified, suspended, or discontinued without notice
• Using the Service may result in emotional distress, anxiety, or other psychological effects
• Relying on the Service or its outputs may lead to negative outcomes, including but not limited to misdiagnosis, delayed treatment, or inappropriate medical decisions
• The Service may not be suitable for your specific needs, circumstances, or medical condition

You assume full responsibility for any and all risks associated with your use of the Service and agree that the Company shall not be liable for any consequences resulting from such risks.

6. Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS ADHD TESTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, AND AFFILIATES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, ACTIONS, LIABILITIES, DAMAGES, LOSSES, COSTS, EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES), AND OTHER OBLIGATIONS ARISING FROM OR RELATED TO:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights, including intellectual property rights or privacy rights
• Any medical decisions, treatment decisions, or healthcare-related actions taken based on the Service or its outputs
• Any content, data, or information you submit, upload, or transmit through the Service
• Your interactions with other users or third parties
• Any consequences resulting from your reliance on the Service or its outputs

This indemnification obligation will survive the termination of these Terms and your use of the Service.

7. Payment Terms and Refund Policy

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE. By making a payment, you acknowledge and agree that:

• All payments are processed through third-party payment processors (e.g., Stripe)
• You are responsible for providing accurate payment information
• You authorize the Company to charge the payment method you provide
• All sales are final - no refunds will be provided for any reason, including but not limited to:
  • Dissatisfaction with the Service or its outputs
  • Technical issues, bugs, or service interruptions
  • Inability to access or use the Service
  • Errors, inaccuracies, or issues with AI-generated content or reports
  • Changes to the Service or discontinuation of features
  • Medical outcomes or lack of desired results
  • Data loss or privacy concerns
  • Any other reason whatsoever
• The Company reserves the right to change pricing at any time without notice
• Access to the Service may be limited, restricted, or terminated at any time without refund
• Access to the Clinical Readiness Session expires 24 hours after a report is generated; after expiry, a new purchase is required to continue
• During the 24-hour window after report generation, you may regenerate/download the report up to four (4) times; regenerations beyond this limit require a new purchase
• You will not dispute charges or request chargebacks except in cases of unauthorized use of your payment method

8. Data, Privacy, and Security

While we strive to protect your data and privacy, you acknowledge and agree that:

• No data transmission over the internet or storage system is completely secure
• The Service may experience data breaches, unauthorized access, or security incidents
• Your data may be lost, corrupted, or accessed by unauthorized parties
• The Company is not responsible for any data loss, corruption, or unauthorized access
• You are responsible for maintaining the security of your device and browser
• The Company may collect, use, store, and process your data as described in our Privacy Policy
• AI processing may involve third-party services that may have access to your data
• The Company may share anonymized or aggregated data with third parties
• You should not submit sensitive, confidential, or personally identifiable information unless you accept the risks

9. Service Availability and Modifications

The Company reserves the right, at its sole discretion, to:

• Modify, suspend, or discontinue the Service or any part thereof at any time without notice or liability
• Change features, functionality, or content of the Service without notice
• Limit, restrict, or terminate your access to the Service for any reason or no reason
• Perform maintenance, updates, or modifications that may interrupt service
• Change pricing, payment terms, or refund policies at any time
• Discontinue support for certain browsers, devices, or platforms

The Company shall not be liable for any losses or damages resulting from such modifications, suspensions, discontinuations, or changes.

10. Prohibited Uses

You agree not to:

• Use the Service for any illegal, unauthorized, or fraudulent purpose
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Interfere with, disrupt, or damage the Service or its servers
• Use automated systems, bots, or scripts to access the Service
• Share, resell, or redistribute access to the Service
• Use the Service to create competing products or services
• Submit false, misleading, or fraudulent information
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of the Company or third parties
• Use the Service in any manner that could harm, disable, or impair the Service

11. Intellectual Property

The Service, including all content, features, functionality, designs, logos, trademarks, and software, is owned by ADHD Tester or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial use in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service or any part thereof without the express written permission of the Company.

12. Termination

The Company may, at its sole discretion, terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, illegal, or unauthorized use of the Service
• Non-payment or payment disputes
• Technical issues or security concerns
• Any other reason at the Company's sole discretion

Upon termination, your right to use the Service will cease immediately, and you will not be entitled to any refund. All provisions of these Terms that by their nature should survive termination shall survive termination.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ADHD Tester operates, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration organization, except where prohibited by law.

You waive any right to participate in a class-action lawsuit or class-wide arbitration against the Company.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and ADHD Tester regarding the Service and supersede all prior or contemporaneous agreements, understandings, or communications, whether written or oral.
